By accessing or using Kultara, you agree to these Terms and to any additional terms shown at the point of purchase or within the app. If you do not agree, do not use the service.
The service
Kultara provides access to soundscapes, audio experiences, creative tools and related digital content. Features, catalog availability and supported devices can evolve over time.
Accounts and access
You are responsible for maintaining the security of any account credentials associated with Kultara and for activity performed through your account. You must provide accurate information where account information is required.
Subscriptions and purchases
When a subscription or purchase is made through Apple’s App Store, billing, renewal, cancellation and refund mechanics are governed by Apple’s applicable terms and account controls. Prices and available plans are those displayed at the time of purchase.
Personal and professional use
Your rights to use Kultara content depend on the plan or license shown at purchase. Personal access does not automatically grant public-performance, commercial, redistribution, resale or synchronization rights. Where Kultara offers professional or commercial-use rights, those rights are governed by the specific plan or license displayed for that use.
Acceptable use
You may not misuse the service, attempt to bypass access controls, reverse engineer protected portions of the service where prohibited by law, scrape or redistribute the catalog, interfere with service operation, or use Kultara in a way that infringes third-party rights.
Wellness disclaimer
Kultara may be used for relaxation, ambience, focus or creative purposes, but it is not a medical device and does not provide medical diagnosis or treatment. Do not use audio in circumstances where reduced awareness could create a safety risk.
Availability and changes
We may update, improve, replace or discontinue features or catalog items. We aim for continuity but do not guarantee uninterrupted availability of every sound, collection or feature at all times.
Liability
To the maximum extent permitted by applicable law, Kultara is provided without guarantees beyond those that cannot legally be excluded. DeepSci Labs LLC is not liable for indirect or consequential loss arising from use of the service, except where such limitation is prohibited by law.
